TERMS AND CONDITIONS OF THE COMMERCIAL OPERATION “FUEL CASHBACK”
1. WHAT DOES THE COMMERCIAL OPERATION CONSIST OF AND WHO IS ORGANIZING IT?
The company LYDIA SOLUTIONS, a simplified joint-stock company with a capital of €1,794,792, registered with the Paris Trade and Companies Register under number 534 479 589, whose registered office is located at 14 avenue de l’Opéra, 75001 Paris (France), and acting as an electronic money institution duly authorized to perform payment services under the supervision of the ACPR (CIB bank code: 17598) (hereinafter “Lydia Solutions” or “Organizer“) organizes a promotional sales campaign entitled “Fuel Cashback” (hereinafter “Commercial Operation“) under the conditions and terms described herein.
The Commercial Operation allows Users (as defined in Article 3 below) to benefit from a refund (hereinafter the “Cashback“) of a portion of their fuel expenses incurred at a service station located on French territory subject to compliance with the conditions set out in these terms and conditions (hereinafter the “TCs”).
Throughout the Duration of the Commercial Operation, the TCs will remain available on Lydia Solutions website.
The French version of this TCs prevails over the English version.
2. HOW LONG DOES THE COMMERCIAL OPERATION TAKE?
The Commercial Operation is organized from April 3, 2026 at 00:00 to May 31, 2026 at 23:59 (hereinafter the “Duration of the Commercial Operation”).
3. WHAT ARE THE ELIGIBILITY REQUIREMENTS TO PARTICIPATE?
The Commercial Operation is reserved exclusively for natural persons of legal age who cumulatively meet the following conditions (hereinafter the “User(s)”) :
- To have open and maintain an active payment account in their name from Sumeria application (hereinafter the “Account”) ;
- To be part of ten thousand (10,000) first Users fulfilling these eligibility conditions and having made an Eligible Payment in accordance with the terms and conditions set out in Article 4 below.
Participation in the Commercial Operation is strictly personal and nominative.
Participation in this Commercial Operation implies full and unconditional acceptance of the TCs in their entirety, which have the force of a contract.
Participation in the Commercial Operation also implies that the User uses the services available in Sumeria application and the Sumeria card in accordance with applicable regulations and the payment account agreement and the card agreement (hereinafter “Agreements”)
For the avoidance of doubt, it is specified that any person who does not meet the above eligibility conditions is excluded from the Commercial Operation (e.g. a person who opened an Account before the Duration of the Commercial Operation, or a User whose Account was opened during the Duration of the Commercial Operation and suspended or closed in accordance with the terms provided for by the regulations in force and/or the Agreements).
4. HOW DOES THE COMMERCIAL OPERATION WORK?
4.1. Eligible Payments
A payment is considered eligible if it cumulatively meets the following conditions (hereinafter “Eligible Payment(s)”) :
- Being a fuel payment made by the User at a service station located in French territory using the Sumeria card;
- To be carried out during the Duration of the Commercial Operation.
The number of payments meeting the above eligibility requirements is strictly limited to five (5) per User. Once this limit is reached, any new Eligible Payment will not generate any Cashback.
The User acknowledges and accepts that any payment not meeting the conditions set forth herein will be excluded from the Commercial Operation and will not give rise to any financial or other compensation.
4.2. Cashback amount
The User will benefit from a Cashback corresponding to ten percent (10%) of the Eligible Payment amount, up to a limit of ten euros (€10) per Cashback.
The total cumulative Cashback amount per User is capped at fifty euros (€50) over the entire Duration of the Commercial Operation. Once this limit is reached, any new eligible payment will not generate any cashback.
4.3. Cashback payment terms
Within the limits set out in Article 4.2 above-mentioned, Cashback will be credited directly to the User’s Account by Lydia Solutions. The payment will be made within a maximum period of fifteen (15) working days following the date of the Eligible Payment.
4.4. Exclusions
The Organizer reserves the right to exclude from the Commercial Operation any User who disrupts the Commercial Operation (in particular in the event of fraud or abuse) or who has not complied with the conditions of the TCs and to deprive the User of any right to payment of the Cashback.
In the event of abuse, fraud or attempted fraud, the Organizer also reserves the right to take any legal action against a User (including in particular any accomplices).
5. WHAT IS PLANNED REGARDING THE PROTECTION OF PERSONAL DATA?
By participating in the Commercial Operation, each User acknowledges and accepts that Lydia Solutions uses the transaction and identification data received within the framework of the Commercial Operation, in particular for the purposes of verifying eligibility and monitoring spending limits and Cashback payment.
Lydia Solutions will ensure that only authorized services have access to personal data and in accordance with the purposes herein.
The personal data of Users used in connection with the Commercial Operation is processed by Lydia Solutions, as data controller, and its potential subcontractors performing services, in accordance with the privacy policy (available on www.sumeria.eu).
Users’ personal data is used for the following purposes:
- Verification of the conditions of participation and eligibility for the Commercial Operation (including Eligible Payments);
- Ensuring the proper management of the Commercial Operation;
- Cashback payment to the Account.
Users have the right to access, rectify, object to, and delete their personal data. All requests must be sent in writing to Lydia Solutions at the following address: dpo@isbs.eu
6. WHAT ELSE DO WE NEED TO KNOW?
6.1. Organizer’s responsibility
The Organizer declines all responsibility for any incidents that may occur during the use of the Sumeria card to make Eligible Payments (e.g., payment terminal failure in a service station, or service station not listed in the payment network).
The Organizer cannot be held responsible for a User’s failure to comply with the conditions of the Commercial Operation, particularly in cases of fraud or attempted fraud.
If circumstances require it, the Organizer reserves the right, at any time and without notice, to shorten, extend, modify, interrupt, suspend, postpone or cancel the Commercial Operation, without any claim being made and without its liability being incurred as a result.
By participating in the Commercial Operation, Users accept and agree to bear sole responsibility for all damages, losses, charges or expenses incurred or suffered as a result of their participation in the Commercial Operation, unless otherwise required by law.
Similarly, the Organizer shall not be held liable if, due to force majeure or circumstances beyond its control, the Commercial Operation must be modified, shortened, or cancelled. In the event of force majeure, adjustments to these TCs may be published during the Duration of the Commercial Operation, using the communication methods freely determined by the Organizer. These adjustments will be considered as appendices to the TCs.
6.2. Evidence
Except in cases of obvious error, it is agreed that the information resulting from the Organizer’s information systems, such as date and time of opening the Account and/or making any Eligible Payment have probative value in any dispute, with regard to the connection elements and the computer processing of said information.
6.3. Claims
Before taking any legal action against Lydia Solutions, the User agrees to try to resolve the dispute amicably.
The User can contact Lydia Solutions’ customer support service directly to submit a complaint by email by contacting: contact@sumeria.eu.
If the User has not received a satisfactory response to their complaint, he can also contact the Lydia Solutions customer complaints department by mail: Lydia Solutions – Customer Complaints/Cashback – 14 Avenue de l’Opéra – 75001 Paris (France).
6.4. Applicable law and Jurisdiction
The TCs are subject to French law.
The Organizer and the Users of the Commercial Operation will endeavor to resolve amicably any dispute arising from the interpretation or execution of these TCs. If the disagreement persists, the French courts will have jurisdiction.
