Promotional Offer Rules “Remunerated Current Account”

These rules of the promotional offer rules “Remunerated Current Account” (hereinafter “Rules”) are applicable from August 1, 2025, they cancel and replace from this date all previous versions having the same object that bound the Parties. 

The French version of this Rules prevails over the English version.

1. Organization

The company, Lydia Solutions, a French limited company (“société par actions simplifiée”) with a capital of 1,788,707 euros, having its registered office at 14 avenue de l’Opéra, 75001 Paris (France), registered with the Paris Trade and Companies Register under number 534 479 589, approved and supervised by the Autorité de contrôle prudentiel et de résolution as an electronic money institution authorized to perform payment services (hereinafter “Lydia Solutions” or “Organizer“),

Organizes a promotional offer entitled “Remunerated Current Account” (hereinafter “Remunerated Current Account Offer”) for customers holding a payment card issued by Lydia Solutions and fulfilling the participation conditions of Article 4 hereof (hereinafter the “Participant(s)“).

The conditions and terms of participation applicable to the Remunerated Current Account Offer are set out below in these Rules.

2. Purpose

To reward their loyalty, Lydia Solutions offers, each month, to Participants who regularly spend with their payment card(s) issued by Lydia Solutions and linked to a payment account opened in the books of Lydia Solutions (hereinafter “Card(s)“) a commercial bonus (hereinafter the “Remuneration“): a percentage of the balance of the different wallets of the payment account opened in the books of Lydia Solutions by the Participant.

3. Duration

These Rules take effect for an initial period of one (1) month, tacitly renewable for the same duration, unless terminated by the Participant or the Organizer under the conditions described herein.

4. Conditions of participation

Each Participant must hold a payment account opened in their name in the books of Lydia Solutions and a Card before the end of the Remunerated Current Account Offer, and until the Remuneration is paid, it being specified that online money pots are excluded from the Remunerated Current Account Offer. The Remunerated Current Account Offer is strictly reserved for French and Belgian tax residents who have confirmed their tax residence with Lydia Solutions (by self-certification).

Participation in the Remunerated Current Account Offer is optional, without obligation of commitment duration and free of charge. Participation in the Remunerated Current Account Offer implies unreserved acceptance and compliance with all the terms of these Rules. In the event of non-compliance with any of the terms of these Rules, participation in the Remunerated Current Account Offer will be canceled and the Organizer may demand reimbursement of any Remuneration unduly received by the Participant.

Similarly, the Organizer reserves the right to refuse any participation in the Remunerated Current Account Offer to any person with an ongoing banking ban, having a dispute with the Organizer and/or having committed one or more fraudulent acts or being suspected of fraud by the Organizer.

A user is considered a “Participant” in the Remunerated Current Account Offer:

  • For any user already having a payment account opened in their name in the books of Lydia Solutions, at the time the Rules take effect.
  • For any user not yet having a payment account opened in their name in the books of Lydia Solutions at the time the Rules take effect, on the day of the opening of said payment account.

At any time, a Participant may terminate their participation in the Remunerated Current Account Offer, without needing to provide a reason, by using one of the following means:

  • By logging into their personal space on the Organizer’s mobile application; or
  • By contacting the Organizer’s customer support service by e-mail at contact@sumeria.eu or by mail at the following postal address: Lydia Solutions – service client – 14 Avenue de l’Opéra – 75001 Paris, France

The Participant’s withdrawal request will be processed by the Organizer within a maximum of ten (10) business days from receipt of the request. The end date of participation in the Remunerated Current Account Offer taken into account by the Organizer is the day the Participant’s request is processed by the Organizer’s services.

In addition to the possibility of terminating their participation in the Remunerated Current Account Offer at any time, the Participant has a fourteen (14) calendar day right of withdrawal which begins to run from:

  • the day after the first payment of the Remuneration for any Participant already having a payment account opened in their name in the books of Lydia Solutions at the time the Rules take effect; or
  • the day after the opening day of the payment account for any Participant not yet having a payment account opened in their name in the books of Lydia Solutions at the time the Rules take effect.

5. Remuneration Calculation Methods 

5.1 Remuneration Calculation

The amount of the Remuneration is calculated monthly, based on daily transaction statements, according to the following methods:

  • To obtain the Remuneration, the Participant must have accumulated for a given calendar month at least ten (10) distinct eligible payments with a Card of which they are the holder.
  • The amount of the Remuneration, for a given calendar month, is then calculated by taking into account the sum, capped at (i) five thousand euros (5,000€), or (ii) one hundred thousand euros (100,000€) if the Participant has subscribed to a Black Card offer, of all balances recorded at the end of the day (mainland France time) each day of the calendar month, of all sub-accounts (with the exception of online money pots) of the payment account opened in the books of Lydia Solutions of which the Participant is the holder, multiplied by the nominal Remuneration rate.
  • The amount of the Remuneration calculated for a given calendar month must be greater than or equal to (i) fifty euro cents (0.50 €) net for Participants who benefit from the “boosted” nominal Remuneration rate, and (ii) twenty-five euro cents (0.25€) net for other Participants.

The nominal Remuneration rate is freely set by the Organizer. This rate is subject to change at any time and without notice, which the Participant acknowledges and accepts. From the date of entry into force of these Rules, the nominal rate of Remuneration may be “boosted” for any Participant, according to the conditions which will be defined by Lydia Solutions on the website www.sumeria.eu and in the Sumeria Application.

5.2 Payment of Remuneration

The payment of the Remuneration is made monthly during the following month by transfer to the Participant’s main payment account opened in the books of Lydia Solutions.

5.3 Eligible Payment Transactions

A payment transaction is considered “eligible” under the Remunerated Current Account Offer if it meets the following conditions:

  • If its amount is greater than or equal to fifty euro cents (0.50 €),
  • If it was made with a Card held by the Participant, and it debited a payment account opened in the books of Lydia Solutions held by the Participant.

The following are not considered eligible payment transactions:

  • Payment transactions for prohibited activities, as defined in the List of Prohibited Activities in connection with the use of the Organizer’s services;
  • Payment transactions for the purpose of gambling and betting operations, including lottery tickets, casino chips, bets and off-track betting;
  • Payment transactions made through a payment service provider, or investment provider, other than the Organizer, its principals and commercial partners;
  • Payment transactions consisting of or having as their object, reloading of bank, payment, electronic money and investment accounts;
  • Transactions external to the payment or electronic money account opened in the books of Lydia Solutions and all other transactions that may directly or indirectly lead to cash generation (also known as “quasi-cash”);
  • Payment transactions not completed, unsuccessful, refused, abandoned, stopped by force majeure and/or reimbursed by the payment beneficiary, and
  • Payment transactions carried out in non-compliance with the contractual documents governing the Organizer’s services mentioned on the Organizer’s website on the following page: Terms and Conditions

6. Taxation

6.1. Each Participant is informed that the elements mentioned below are applicable only to Participants who are French tax residents: the Remuneration received is taxable under the Flat-Rate Withholding Tax (PFU) (available in French only). The overall PFU rate is 30%, including:

  • 12.8% collected as income tax, in the year the Remuneration is paid, withheld as an advance payment. The final taxation then occurs at the time of the income declaration. The Participant may indeed opt for taxation at the progressive scale of income tax when filing their annual income declaration.

Depending on their reference tax income, the Participant may request the Organizer for an exemption from paying the tax advance (available in French only) due as income tax. This request takes the form of a sworn declaration sent to customer service by email at contact@sumeria.eu or by mail to the postal address: Lydia Solutions – customer support service – 14 Avenue de l’Opéra – 75001 Paris for consideration within the deadlines provided by law.

  • 17.2% collected as social security contributions.

6.2. For other Participants, it will be their responsibility to make all tax declarations required by local law (including any tax, contribution, or other fees to be paid to local administrative bodies).

The Organizer invites Participants to contact the competent tax services for any questions.

7. Processing of personal data

The Participant’s personal data used within the framework of the Remunerated Current Account Offer is processed by the Organizer, as data controller and its potential subcontractors performing services, in accordance with the Data Protection Policy.

8. Modifications to the Rules at the Organizer’s initiative

The Organizer reserves the right to modify or terminate the Remunerated Current Account Offer at any time and without notice, including before the expiration of the initial duration defined in Article 3 hereof, if it appears that frauds or attempted frauds, in any form whatsoever, proven or suspected, have occurred.

Upon expiration of the initial duration and subject to the regulatory provisions applicable to the Organizer’s activity and if the Remunerated Current Account Offer is extended, the Organizer reserves the right to modify the terms of these Rules at any time and without notice, particularly to take into account any regulatory changes, without its liability being engaged in any way as a result, the Participants being unable to assert a right to any compensation whatsoever.

Each modification will be announced on the Organizer’s website at the location of these Rules, accompanied by a communication of the modified Rules. All cases not provided for by these Rules will be the sole responsibility of the Organizer.

9. Claims and disputes

Before initiating any legal action against the Organizer, Participants undertake to try to settle the dispute amicably.

First recourse:

  • Each Participant can directly contact the Organizer’s customer support service to submit a claim by email by contacting contact@sumeria.eu or directly from their personal space on the Organizer’s mobile application.
  • If the Participant has not received a satisfactory response to their claim, they can also contact the Organizer’s customer claims department by mail: Lydia Solutions – Customer Claims Department – 14 Avenue de l’Opéra – 75001 Paris, France

Except in exceptional cases:

  • Within ten (10) business days from the receipt of their claim by the Organizer, the Participant receives confirmation that their claim is being processed; and
  • A definitive response to the claim is communicated to the Participant within a maximum of two (2) months.

Last amicable recourse

The mediator is the last amicable recourse before undertaking legal action.

The Participant can, free of charge and in writing, refer the matter to the AFEPAME consumer mediator, provided that:

  • They disagree with the response provided by the Organizer’s customer support or by the Organizer’s customer claims department; or
  • They have not received a response to their claim within two (2) months.

Referring the matter to a mediator constitutes express authorization for the Participant to waive professional secrecy with respect to the Organizer concerning the communication of information necessary for the mediation’s investigation, which the Participant acknowledges and accepts.

10. Liability

The Organizer’s liability cannot be engaged if, in the event of an event constituting a case of force majeure as defined by Article 1218 of the Civil Code and according to the interpretation adopted by the jurisprudence of the Court of Cassation, the Remunerated Current Account offer should be modified, suspended, shortened, terminated or canceled.

By participating in the Remunerated Current Account Offer, Participants accept and undertake to bear alone all damages, losses, charges or costs caused or suffered as a result of their participation in the Remunerated Current Account Offer, unless otherwise provided by public policy.

11. Language and availability of the Rules

These Rules are written in French. The French version of the Rules is available free of charge on the Organizer’s mobile application and on its website.

Throughout the duration of the Remunerated Current Account Offer, the Rules will remain available on the Organizer’s website and an electronic copy can also be sent free of charge by e-mail, upon simple request to the Organizer’s customer service.

12. Applicable law and competent jurisdiction

These Rules are subject to French law.

For any dispute not resolved amicably, and unless otherwise provided by public policy, French courts will have jurisdiction.
